Coastal Area in Tangerang Holds HGB, Minister of Marine Affairs: No Certificate Should Exist Underwater!

DIGIVESTASI - The Minister of Maritime Affairs and Fisheries, Sakti Wahyu Trenggono, emphasized that building use rights certificates (HGB) or land ownership certificates (SHM) are not allowed in marine areas. He stressed that managing marine areas should require a Marine Spatial Planning Activity Utilization Suitability (KKPRL) permit. This statement was made by Trenggono regarding the presence of HGB certificates in the sea fence area in Tangerang, Banten.

 

"I just heard in a press conference from the Minister of ATR-BPN that there are certificates recorded in the seabed. I want to say that such certificates are invalid. It's clearly illegal," said Trenggono after a meeting with President Prabowo Subianto at the State Palace on Monday (January 20, 2025).

 

Trenggono explained that the installation of the sea fence in Tangerang Regency is suspected to be related to a natural reclamation project. His team is now investigating the fence, which stretches for 30.16 kilometers, including issues related to ownership.

 

The sea fence is believed to be intended to block sand carried by the sea waves. Over time, the sand will continue to accumulate and form land.

 

"The purpose is for the land to rise. The sand that is trapped will continue to pile up with the waves. Indirectly, this is like natural reclamation," explained Trenggono.

 

According to him, this natural reclamation could produce a large area of land, which could potentially span thousands of hectares.

 

"If this happens, a very large area of land will be formed. From our estimates shared with the President, we estimate it could reach around 30,000 hectares," added Trenggono.

 

As a follow-up, the Ministry of Maritime Affairs and Fisheries (KKP) began the sealing process on January 9, 2025, following the instruction of President Prabowo Subianto. On January 18, 2025, a joint team from the Indonesian Navy (TNI AL) started dismantling part of the sea fence, which is 2 kilometers long.

 

Trenggono confirmed that the dismantling will continue on Wednesday, January 22, 2025, as per the joint agreement with the Indonesian Navy.

 

"We are giving time until Wednesday morning. After the meeting in the afternoon, we will continue the dismantling," explained Trenggono in a video post on his Instagram account @swtrenggono on Monday (January 20, 2025).

 

Previously, the Minister of ATR-BPN, Nusron Wahid, confirmed that the sea fence area in Tangerang, Banten, indeed holds HGB and SHM certificates. The investigation regarding this finding emerged after internet users discovered information about the HGB certificates in the ATR/BPN BHUMI application.

 

"We confirm that there are certificates found in the area around the sea fence, as widely discussed on social media," said Nusron.

 

According to him, there are 263 plots with HGB certificates and 17 other plots with SHM certificates. The HGB certificates are held by several companies, including PT IAM with 234 plots, PT CIS with 20 plots, and 9 plots held by individuals. However, Nusron did not elaborate on who the owners of these companies are.

 

"Those who wish to know more about the owners of these companies can directly contact the General Legal Administration (AHU) to check the related data," he added.
